A NEW LAW THAT WILL ALLOW THE PEOPLE TO CHOOSE
Inspirados en los ideales proclamados en la Campaña Foro Cubano, hemos presentado en las oficinas de la Asamblea Nacional del Poder Popular, una petición ciudadana para que se derogue la actual Ley Electoral, Ley No. 72 y sea aprobada una nueva Ley Electoral que garantice a los ciudadanos cubanos los derechos a elegir y a ser elegidos.
La Ley Electoral vigente define un sólo candidato por cada escaño de delegado a las Asambleas Provinciales y un sólo candidato por cada escaño de Diputado a la Asamblea Nacional del Poder Popular, por lo que los ciudadanos no eligen.
La Ley No. 72 establece las Comisiones de Candidaturas, como las únicas facultadas a proponer candidatos a Delegado a las Asambleas Provinciales y a Diputados a la Asamblea Nacional del Poder Popular. Esto impide que los ciudadanos puedan nominar libremente para esos asientos a las personas de su referencia.
En el texto de esta Ley se enmascaran estas privaciones con mecanismos como el “voto unido” y la posibilidad de que cada elector pueda votar por todos os candidatos que encuentre en su boleta, en vez de votar por su candidato a delegado y a diputado. Si por una parte, la Ley está llena de contradicciones con la propia Constitución y con el derecho a la soberanía, que reside en el pueblo; por otra parte, el ambiente de intolerancia y la falta de respeto a la libertad y a los derechos civiles y políticos hacen imposible que el proceso electoral sea verdaderamente democrático.
El pueblo de Cuba quiere cambios, cambios pacíficos, y le corresponden todos los derechos y facultades para definir esos cambios y decidir sobre su destino. La Ley Electoral y las elecciones son el campo donde se puede escamotear o realizar este derecho a la soberanía. Por lo tanto, llamamos a todos los cubanos a que pongan atención y apoyen esta demanda de una nueva Ley Electoral y de un orden y un ambiente de respeto a la libertad de expresión y al derecho de todos los ciudadanos a participar, según su propio criterio, en la vida política de nuestra Patria. Por defender esos derechos, pacíficamente, están en prisión injusta muchos cubanos.
Hay diversas opiniones sobre la realidad cubana, diversas opiniones sobre el pasado y también diversas opiniones sobre cómo debe ser la vida en el futuro. Esa diversidad no debe enfrentar a los cubanos, sino enriquecer nuestras vidas. Pero en lo que sí debemos estar de acuerdo, es en que todos los cubanos tenemos derecho a todos los derechos. Para que los cubanos puedan decidir y trabajar juntos por un futuro mejor para todos, es imprescindible que las leyes garanticen el ejercicio de esos derechos. Un derecho esencial es el derecho a elegir libre y democráticamente a los representantes de los ciudadanos en todas las instancias de gobierno.
Las elecciones no son un paso cualquiera. Si son verdaderamente libres y democráticas, serán el paso que definirá la orientación del camino de nuestro pueblo hacia una nueva etapa de nuestra historia, donde superemos lo que nos divide y enfrente, y lo que atenta contra nuestra dignidad y salvemos todo lo bueno y noble que hay en nuestra sociedad. Pero esto sólo se puede hacer como hombres y mujeres libres. En este momento de nuestra historia, Cuba necesita de transparencia y de confianza y eso sólo puede lograrse en el respeto a las ideas y a los derechos de todos, y no imponiendo un proceso electoral con la misma ley, con las mismas reglas y en l mismo ambiente que durante años ha impedido que el pueblo se exprese y decida libremente. Para este tiempo nuevo, Cuba necesita leyes y elecciones nuevas. Y transformar las mentes y los corazones, para que también sean nuevos y mejores.
Nuestro pueblo levanta la mirada hacia el futuro y quiere ver, y tiene derecho a ver, un nuevo horizonte de reconciliación, de paz y de libertad.

A NEW LAW THAT WILL ALLOW THE PEOPLE TO CHOOSE
Inspired by the ideals proclaimed in the Cuban Forum Campaign, we have submitted a citizens’ petition to the offices of the National Assembly of People’s Power, which calls for the Electoral Law, Law No. 72, to be repealed and for a new electoral law to be approved that will guarantee the right of Cuban citizens to elect and be elected.
The current Electoral Law allows for only one candidate for each seat in the Provincial Assemblies and one candidate for each seat in the National Assembly of People’s Power and does not allow citizens to choose between different candidates.
Law No. 72 establishes the Candidacy Commissions as the only bodies authorized to propose candidates for delegates to the Provincial Assembly and members of the National Assembly of People’s Power. This impedes citizens from freely nominating the candidates that they prefer to these positions.
These provisions are disguised within text of this Law by mechanisms such as the “united vote” and the possibility that an elector may vote for all of the candidates that are on their ballot instead of voting for his own delegate and member. If on the one hand, the Law is full of contradictions with the Constitution and with the right to sovereignty, which resides within the people; on the other, the environment of intolerance and lack of respect for liberty and civil and political rights makes it impossible for the electoral process to be truly democratic.
The Cuban people want change, peaceful change, and they deserve to have the rights and the abilities to define those changes and to decide their own fate. The Electoral Law and elections constitute the sphere in which the right to sovereignty may be either gained or lost. Therefore, we call on all Cubans to review and to support this petition for a new Electoral Law and for an environment in which freedom of expression and the right of all citizens to participate, according to their own criteria, in the political life of our Homeland. Many Cubans are unjustly imprisoned for peacefully defending these rights.
There are different opinions on the reality currently faced by Cubans, different opinions on the past and different opinions on what life in the future should be like. This diversity should not be a source of conflict among Cubans, but rather it should enrich our lives. But there is one thing on which we should all agree: that all Cubans have the right to all of their rights. In order for Cubans to decide on a better future for all and work together to achieve it, it is indispensable that the laws guarantee the exercise of these rights. An essential right is the right of citizens to freely and democratically elect their representatives in all levels of government.
Elections are not an ordinary event. If they are truly free and democratic, they will be the step which will define the path for our people toward a new era of our history, where we will overcome that which divides us and challenges us, that which attacks our dignity. It will be an era in which we will save all that is good and noble in our society. But this future can only come to pass if we are free men and women. In the present moment of our history, Cuba needs transparency and trust, and this can only be achieved by respecting the rights and ideas of all. For this future to transpire, an electoral process may not be imposed on Cubans with the same law, the same regulations and the same environment which for years have impeded the people from expressing themselves freely. For this new era, Cuba needs new laws and new elections. But most of all, we need to transform our hearts and mind so that they too are made new and better.
Our people are raising their gaze towards the future, and they want to see, and have the right to see, a new horizon of reconciliation, peace and liberty.
